1. About These Terms

These Terms of Service apply to your use of our website and any purchase you make from Formiva (“we”, “us”, “our”). By visiting our store or placing an order, you agree to these terms. If you don’t agree, please don’t use our store.

2. Eligibility

You must be 18 or older, or have permission from a parent or guardian, to place an order. You agree to give accurate and complete information when you buy.

3. Products and Pricing

We show product colors, sizes and descriptions as accurately as we can. Screens differ, so colors may vary slightly.

All prices are in South African rand (ZAR) and include VAT where applicable.

We may change prices or stop selling a product at any time. A price change doesn’t affect orders we have already confirmed.

If a price or description is clearly wrong, we may cancel the order and give you a full refund.

4. Orders and Payment

Your order is a request to buy. It is confirmed once we have received your payment.

We accept [card payments, instant EFT and] manual EFT / bank transfer.

For EFT orders, use your order number as the payment reference and send proof of payment to [email/WhatsApp]. We process your order once the payment has cleared in our account.

If we don’t receive payment within [48 hours] of an EFT order, we may cancel it.

We may refuse or cancel an order if we suspect fraud, an error, or if the item is out of stock. If we cancel after you have paid, you get a full refund.

5. Delivery

We deliver within South Africa only. Delivery is free. Our delivery times and rules are set out in our Shipping & Delivery Policy, which forms part of these terms. Please check your address and phone number before you pay.

6. Returns and Refunds

Returns, exchanges and refunds are covered by our Returns & Refund Policy, which forms part of these terms. For hygiene reasons, shapewear must be unworn, with the hygiene seal intact, to qualify for a change-of-mind return or exchange.

7. Product Use and Results

Our shapewear is designed to shape and support the body’s appearance. It is not a medical product and does not treat any health condition.

Results and fit differ from person to person. We don’t guarantee weight loss or any specific body result.

Please check our size chart before you order. Stop wearing an item if it causes pain, difficulty breathing or discomfort, and speak to a health professional if you have a medical condition or are pregnant.

8. Intellectual Property

All content on this website, including text, images, logos and design, belongs to Formiva or is used with permission. You may not copy, reproduce or use it for commercial purposes without our written permission.

9. Acceptable Use

You agree not to misuse our website, including by trying to gain unauthorised access, interfering with how it works, submitting false orders or using it for any unlawful purpose.

10. Limitation of Liability

To the extent allowed by law, Formiva is not liable for indirect or consequential losses arising from your use of our website or products. Nothing in these terms limits your rights under the Consumer Protection Act 68 of 2008 or any other law that can’t be limited by agreement.

11. Privacy

We collect and use your personal information, such as your name, address, phone number and email, only to process orders, deliver products and communicate with you. We handle your information in line with the Protection of Personal Information Act (POPIA). Please see our Privacy Policy for details.

12. Third-Party Services

We use third parties such as payment providers and couriers to process payments and deliver orders. We are not responsible for their systems, but we will help you resolve any issue that arises with your order.

13. Changes to These Terms

We may update these terms from time to time. The version on our website at the time you place your order applies to that order.

14. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any dispute will be handled by the South African courts, unless the law gives you the right to go elsewhere.
